Extra requirements apply to aeroplanes used under the exemption EX74/24 (formerly EX97/22). People often refer to this as the MOPSC 10 to 13 seat exemption.
Autopilot
You must comply with the automatic pilot requirements of subsection 11.10 (2) of the Part 135 MOS.
Subsection 11.10 (3) of the Part 135 MOS does not apply to any flights. Instead, an automatic pilot may be inoperative at the beginning of a day VFR or day IFR VMC flight only if it begins:
- from an aerodrome that doesn’t have a facility to repair or replace the automatic pilot
- within 24 hours of finding the issue.
These provisions make sure automatic pilot aren’t inoperative for more than 24 hours, or if departing from an aerodrome where they can be repaired.
Terrain awareness warning systems (TAWS)
For an IFR flight, or a VFR flight at night, a turbine-engine aeroplane with a MTOW greater than 5700kg must be fitted with a TAWS-Class A.
For an IFR flight, or a VFR flight at night, a turbine-engine aeroplane with a MTOW of 5700kg or less must be fitted with a TAWS-Class A or TAWS-Class B+.
For an IFR flight, or a VFR flight at night, a piston-engine aeroplane must be fitted with a TAWS-Class A, TAWS-Class B+ or TAWS-Class B.
For a VFR flight by day, you must fit your aeroplane with a TAWS-Class A, TAWS-Class B+ or TAWS-Class B.
Flights fitted with TAWS due to EX74/24 have different rules for when the TAWS can be inoperative compared to other flights under the Part 135 rules.
A TAWS fitted under EX74/24 must be functioning on all air transport flights except if the flight starts from an aerodrome without TAWS repair or replacement facilities and you find the issue within 24 hours of the flight.
Please be aware that operations under EX74/24 cannot use the inoperative TAWS rule in paragraph 11.26(b) of the Part 135 MOS.
Weather radar
An aeroplane operated under EX74/24 must be fitted with weather radar.
The weather radar may be inoperative in the circumstances described in section 11.28 of the Part 135 MOS.
