The Business Transport Technical Working Group (TWG) seeks to allow business transport flights to count as private operations in the longer term.
From 2 December 2021, amendments to flight operations regulations clarified that we classify any operation that provides a benefit to the aircraft operator as air transport. This aligns with the former charter definition. Some flights that were previously private operations now need an air operator certificate under Parts 121, 133 or 135. This includes business transport operations, such as flying aircraft owners for business purposes.
Because the amendment did not include transitional provisions, we issued a temporary exemption. This allows business transport flights to count as private operations at an appropriate safety level while we develop long-term policy.
The Business Transport TWG will develop:
- policy
- rules
- supporting guidance materials.
They will take into consideration the kinds of:
- aircraft
- passengers
- cargo.
