Indemnity arrangements for flight examiners

We indemnify flight examiner rating holders. This covers any liability or loss that results from them exercising their privileges. It includes flight tests and granting of ratings.

An indemnity is a form of protection or insurance provided by us to a specific group of individuals.

There are a range of limitations and exclusions you should be aware of.

Who we cover

We provide indemnity to a limited group of individuals. These individuals carry out tasks that support aviation safety.

The indemnity extends to:

  • Delegates appointed under regulation 11.260 of the Civil Aviation Safety Regulations 1998 (CASR).
  • Authorised Persons appointed under regulation 201.001 of the CASR.
  • Flight Examiner Rating (FER) holders under regulation 61.1255 of the CASR.

These people do tasks that we would usually do ourselves.

Our indemnity arrangements

We have provided indemnity to FER holders since 1 September 2018.

Before 1 September 2018, our arrangements covered FER holders as a CASA Approved Testing Officer.

There are limitations to the indemnification. Our arrangements do not cover you are where you:

  • unlawfully exercise the privileges of your rating
  • are fraudulent or dishonest
  • act with reckless disregard
  • act outside the range of CASA’s legislative functions.

The liability covers you up to $100 million. You should take out your own insurance to cover liability:

  • more than $100 million
  • for activities excluded by our cover.

We based this policy on the Australian Government's self-managed insurance fund, Comcover.

Approvals not covered by indemnity

Approvals issued under regulation 61.040 of CASR do not meet the criteria for indemnity coverage. These approvals are not:

  • given under rule 201.001
  • classed as delegates or FER holders.

Therefore, these indemnity provisions do not cover holders of a regulation 61.040 approval. This was also the original intention for these approvals.
