Project Closure Notes
The amendments to CASR Part 39, Airworthiness Directives (ADs), have now been completed and signed by the Governor General in April 2009. The new rules will require all registered operators to ensure their aircraft complies with State of Design ADs. Also the new rules will allow automatic acceptance of an alternative means of compliance (AMOC) against an AD approved by the State of Design.
The new rules will come into effect on 1 October 2009.
The NFRM 0709CS - Proposal to Automatically Mandate Compliance with Airworthiness Directives issued by the State of Design - Amendments to CASR Part 39 details the changes to CASR Part 39 and Advisory Circular, AC 39-01(3)- Airworthiness Directives, provides advisory information with regard to compliance of ADs.
CASA currently issues Australian Airworthiness Directives (ADs) under CASR Part 39 to mandate ADs and other mandatory airworthiness information issued by a State of Design. This practice aligns with Part 39 in the USA where the Federal Aviation Administration issues its own ADs to mandate foreign ADs. However, many other aviation authorities have recently introduced legislation to automatically adopt country-of-origin ADs, either for all or certain types of aircraft on their registers.
This project will consider amending CASR Part 39 to allow for automatic acceptance of country-of-origin ADs for Australian-registered aircraft.
