Explanatory Statement

Section 98 of the Civil Aviation Act 1988 (the Act) empowers the Governor-General to make regulations.

Subregulation 5(1) of the Civil Aviation Regulation 1988 (CAR 1988) contains a power enabling CASA to issue Civil Aviation Orders (the Orders).

This Order, made under subregulation 5 (1), repeals sections 50.1 and 51.1 of the Orders.

Sections 50.1 and 51.1 contained conditions for the granting of air traffic control and flight service licences and ratings under CAR 1988.

Provisions enabling the granting of those licences and ratings are now contained in Part 65 of the Civil Aviation Safety Regulations 1998. The equivalent provisions that were contained in CAR 1988 have been repealed.

One effect of these amendments is that sections 50.1 and 51.1 are no longer required.

This repeal came into effect on gazettal.

This Order has been made by the Director of Aviation Safety under subregulation 84A (2) of the Act.
