Key proposals - development of Part 132
The most significant features of the proposed regulations are described below.
- Owners, operators, registered operators and pilots of limited category aircraft would be required to make applications for approvals and permissions to an approved self-administering aviation organisation where one exists (’relevant person’) unless a specific subregulation states that an application must be made to CASA.
- If there is no relevant approved self-administering aviation organisation for the aircraft, then the applications would be made to CASA.
- Each limited category aircraft operator would be required to produce a limited category aircraft manual (LCAM) and have it approved by the relevant person.
- An LCAM would be required to contain details of the aircraft, the operator and the types of operations that would be carried out in the aircraft.
- The manual would also be required to describe how the operations would be carried out in compliance with the regulations and any operational limitations that apply to the aircraft involved in the operations.
- Offence provisions for failing to operate in accordance with the manual may apply to both the aircraft operator and the pilot.
- The operator of a limited category aircraft or their agent would be required to provide a safety briefing to passengers or the purchaser of the flight at the time of arranging for or selling a flight. The operator would be required to provide a further safety briefing before passengers entered the airside area of an airport to board the aircraft.
- Existing regulations do not identify personal use as an appropriate use of a limited category aircraft. Part 132 of CASR would specifically allow flights for personal use and cost sharing flights.
- Existing regulations do not include air racing as a purpose for which limited category aircraft may be used. Part 132 of CASR will include air racing as an authorised use. This will allow operators of unmodified limited category aircraft, which are not eligible for a certificate of airworthiness in the experimental category, to participate in such events.
- Limited category aircraft with a Permit Index numbers are categorised as follows:
- Permit Index number of 1 - would be permitted to fly over a populous area only in accordance with a written approval granted by the relevant person. The formulation currently used in in subparagraph 262AM (10) (b) (i) of the Civil Aviation Regulations 1988 (CAR), namely, ‘to the least extent necessary to take off from or land at a particular aerodrome’ will not be used in the new regulations.
- Permit Index number of 2 - would not be permitted to fly over a populous area unless approved by CASA.
- Permit Index number of 3 - would not be permitted to fly over a populous area.
From the time Part 132 of CASR comes into effect, limited category aircraft that have been used in the conduct of parachuting operations would no longer be permitted to be used in the conduct of parachute training or tandem parachute operations. Limited category aircraft would still be permitted for the use of licensed parachutists.
