Federal Court prohibition orders
In accordance with the Civil Aviation Act 1988, CASA may suspend a civil aviation authorisation for five business days where there is a serious and imminent safety risk. Such suspensions must cease after five days unless CASA applies to the Federal Court for a prohibition order before the expiry of the five-day period.
CASA made two applications to the Federal Court for a prohibition order during 2008–09. Both were in relation to an Air operator’s Certificate.
One application filed by CASA in 2007–08 was heard and determined on 14 July 2008 (see ‘Significant judicial decisions’ for more information).
