CASA EX05/18 — Implementation of Drug and Alcohol Management Plans Exemption 2018
What is it?
This CASA instrument contains two (2) exemptions that are in accordance with proposed policy changes in future amendments to the CASR Part 99 regulations.
These exemptions permit the following: a DAMP organisation to contract another DAMP organisation without having to apply its DAMP to the contracted employees; and a DAMP organisation to contract Emergency Services personnel during a time of emergency under an acceptable means of compliance.
What are the benefits?
The first exemption (i.e. section 4 of the instrument) permits one DAMP organisation that contracts another DAMP organisation, for example the holder of an Air Operator’s Certificate (AOC) contracting the services of an Approved Maintenance Organisation (AMO), to accept the DAMP of the contracted organisation. This removes the requirement of the DAMP organisation from having to apply its DAMP to the employees of the contracted organisation.
Note: The above exemption is not applicable to any non-DAMP organisations such as a ground handling agent for example. That is, it is ONLY applicable to organisations classified as DAMP organisations under sub-regulation 99.030 of CASR.
The second exemption (i.e. section 5 of the instrument) removes the obligation from a DAMP organisation to apply its DAMP to a contracted emergency service provider, if that provider is a non-DAMP organisation, when it is not reasonably practicable to do so in short -notice response to an emergency (i.e. less than 24 hours). Under the circumstances detailed in the instrument, this exemption provides an acceptable means of compliance.

Both exemptions contained in this CASA instrument carry specific obligations for all parties involved, including record-keeping requirements due to providing acceptable means of compliance.
