Delegation under 11.056
As a result of amendments to Parts 11 and 21 of CASR 1998 in 2011, for certain provisions in the CASR, persons appointed as delegates and authorised persons did not, by reason of that appointment alone, hold a power to impose conditions under regulation 11.056 of CASR 1998 on authorisations that they issued.
On 23 November 2012, the Acting Director of Aviation Safety signed instrument CASA 383/12 containing a general delegation for delegates and authorised persons to impose conditions under regulation 11.056 of CASR 1998 when issuing authorisations.
In relation to conditions set out in an authorisation issued under regulation 11.056 prior to 23 November 2012, CASA takes the view they are valid as a delegate or authorised person may be taken to have had implied power to impose such conditions as agent for CASA, when exercising power to otherwise issue an associated authorisation.
