CASR Part 117 - Representations and surveys
Part 117 of CASR provides requirements and offences relating to industry participants making misrepresentations about holding certain civil aviation authorisations and updates industry compliance provisions for safety-related surveys and questionnaires.
Who Part 117 affects
The misrepresentation provision applies to any person who represents to another person, in any way, that the person is willing to conduct an activity using an aircraft; and the person does not hold a particular civil aviation authorisation authorising the person to conduct the activity using the aircraft; and under the Act or the Regulations, it is an offence for a person to conduct the activity using the aircraft if the person does not hold the civil aviation authorisation.
The survey or questionnaire direction may only be given by CASA to (a) an AOC holder, (b) Part 141 operator who conducts flight training in aircraft; (c) a person who operates a very small RPA for hire or reward without an operator certificate; (d) an RPA operator certificate holder.
