Compliance-related action taken by CASA is action that does not involve the exercise of CASA’s specific legislative powers, is generally not reviewable by an external body and is used for less serious breaches. Counselling, or the recommendation for remedial training – usually as part of the counselling process, is a response that fits into this category and is generally used where an instance of non-compliance is determined to have been inadvertent, minor, and there is little or no impact on aviation safety.
Counselling may be the most appropriate action in cases of ignorance or misinterpretation of the law. Where non-compliance is the result of a lack of competency a recommendation that remedial training be undertaken may be more appropriate.
