2nd Consultation on CD 1310SS – Provision of Group ratings covering small aircraft maintenance
2nd consultation July 2015
Following the first consultation on CD 1310SS in March 2015, the Part 66 small aircraft licensing proposals and exposure draft have been reviewed and discussed in detail by CASA and industry representatives at the Maintenance Standards Subcommittee meetings (May and June 2015). Industry requested that, rather than have a separate licence for general aviation, CASA seeks development of legislation that uses the current Part 66 B1 and B2 licences to provide the outcome i.e. group ratings on a Part 66 licence in lieu of a new small aircraft licence.
Accordingly, the proposed Civil Aviation Legislation Amendment (Part 66) Regulation 2015 and proposed changes to the Part 66 MOS have been revised and re-drafted to provide for group ratings to be endorsed on the current B1 and B2 licences. The main changes made to the proposal as a result of discussions and feedback from industry and sub-committee members are as follows:
- termination of the key proposal, originally published in NPRM 1310SS, to introduce five small aircraft licences (SAL)—B1.1SAL, B1.2SAL, B1.3SAL, B1.4SAL and B2SAL—limited for use on small aircraft
- in lieu of the proposed SAL structure, introduction of new ratings (group ratings) for the Part 66 licence, for each B1 subcategory and B2 category licence, that will cover maintenance of the systems and subsystems on small aircraft
- provision for group ratings to provide licence scope that increases by way of modular build-up, i.e. through completion of relevant additional competency-based training (i.e. theoretical training) and relevant experience on aircraft (i.e. practical training).

In September 2014, CASA released a Notice of Proposed Rule Making (NPRM) 1310SS – Maintenance personnel licensing for small aircraft which provided details of a proposal to introduce a modularised aircraft maintenance engineer licence structure for use on small aircraft, like the existing B1 and B2 licence structure of Part 66 of the Civil Aviation Safety Regulations 1998 (CASR) 1998. The proposed small aircraft licence (SAL) would use a positive statement of licence privileges, rather than the use of exclusions/limitations, with endorsements added to the licence as competencies are achieved from a Part 147 Maintenance Training Organisation delivering the Certificate IV in Aeroskills (Mechatronics) training package.
The International Civil Aviation Organization's (ICAO) recently included the concept of competency-based training and modularised licences for aircraft maintenance personnel as a recommended practice in Chapter 4 of their Air Navigation Services Training Procedures Doc 9868. The SAL proposal that was introduced by CASA in NPRM 1310SS includes these practices. The proposed expansions of Part 66 and the Part 66 Manual of Standards (MOS) legislation would continue to use the Australian competency-based training system to deliver the training outcomes required for small aircraft licences and endorsements.
The NPRM also outlined the legislative drafting instructions to give effect to certain requirements of Part 66 to accommodate the proposed SAL structure, as well as the sections within the Part 66 MOS that would require rework to satisfy the proposed licence structure.
This ‘Exposure Draft’ of the Civil Aviation Legislation Amendment (Part 66) Regulation 2015 instrument details the changes required to Part 66 to include the SAL structure, including the following:
- that the definition of an ‘aircraft engineer licence’ includes a SAL
- inclusion of a definition for a SAL
- that the definition of ‘aircraft type training’ includes ‘an endorsement’
- that the definition of ‘category training’ includes training in the required units of competency for particular endorsements on a SAL
- inclusion of a definition of endorsement
- amendments to certain definitions in regulation 66.010 to include mention of licence ‘endorsements’ for a SAL
- amendments to regulation 66.015 that allows the Part 66 MOS to specify:
- the privileges that a SAL holder whose licence is endorsed with an endorsement may exercise
- the required aircraft type training or units of competency for endorsement on a SAL
- the endorsements that are required for a particular SAL
- the sequence in which endorsements may or must be granted for a particular SAL
- the aircraft systems or subsets of aircraft systems covered by an endorsement.
- The list of aircraft engineer licences and the types of aircraft for which each licence applies to, to include the SAL licences
- confirmation that use of exclusions for grant of a licence is not applicable to a SAL
- new Subpart that cover all aspects of endorsements for a SAL including:
- applications for endorsements
- grant of endorsements
- determination of equivalence of certain endorsements and authorisations held at or before application
- removal of conditions that may be on an endorsement
- the training, assessment and experience requirements for removal of conditions.
- amendments to conditions on licences to include offences not to comply with conditions
- inclusion of endorsements for the requalification requirements of a licence
- the maintenance certification requirements under Part 66 for a SAL
- the certificate of release to service requirements under Part 66 for a SAL
Civil Aviation Fees Regulations 1995
- various amendments made to accommodate CASA processing of SAL applications
- miscellaneous updates to remove mention of repealed fees that related to CAO 100.66 maintenance authorities.
Civil Aviation Regulations 1988 (CAR 1998)
- expansion of Schedule 8 – Pilot maintenance to include permission for the conduct of certain pilot maintenance tasks currently provided by CASA instruments including:
- balloon maintenance that may be carried out by certain qualified balloon pilots
- maintenance of warbirds.
- inclusion of a provision for a CASA instrument to be made for permission to carry out the maintenance of amateur-built aircraft, kit-built aircraft or light sport aircraft, with conditions for the carrying out of that maintenance to be prescribed under that instrument.
Transitional regulations applicable to Part 66 of CASR
- amendments to the transitional regulations to include the SAL
