Amendments to CASR Part 139 and MOS Part 139
CASA has posted the legal drafts for amendments to CASR Part 139 and MOS Part 139 for project AS 08/08 (Amendment of CASR Part 139 and MOS Part 139 - Regulations for the control of vehicles operating on the manoeuvring area of certain high-density aerodromes).
As a result of comments received from the earlier consultation and further review, these amendments have been revised. Subject to approval by the Director of Aviation Safety, CASA intends to proceed with final rule making and will publish a Notice of Final Rule Making (NFRM) in due course.
Please note that the Amendment Regulations also relate to projects:
- AS 10/23 (Terminology amendment and review of Terminal Instrument Flight Procedure withdrawal protocol - Manual of Standards Part 173 - Standards applicable to Instrument Flight Procedure Design); and
- AS 10/24 (Clarifying terms used in relation to Terminal Instrument Flight Procedures).
The amendments to the CASRs for projects AS 10/23, AS 10/24 and AS 08/08 have been combined by OLDP in the one set of Civil Aviation Safety Amendment Regulations. Schedule 1 of the Amendment Regulations contains the amendments related to project AS 08/08 and AS 10/24. Schedule 2 of the Amendment Regulations contains the amendments related to project AS 10/23.
The possibility of the occurrence of vehicle and aircraft runway incursions, particularly in low visibility weather conditions, has become a significant safety concern among the advanced aviation nations. Airservices Australia has taken steps to provide aerodrome surface surveillance equipment and related air traffic control procedures designed to limit the occurrence, by providing radar-like surveillance at certain high-density aerodromes (initially at Sydney, Melbourne, Brisbane and Perth). The surveillance equipment involves aircraft and vehicles being fitted with modern transponders that provide transmissions of exact location and identity of vehicles and aircraft when on the aerodrome surface.
The project will establish regulatory power and technical standards applicable to aerodrome vehicles operating on the manoeuvring area for the control of runway incursions at certain high-density aerodromes when required for air traffic control purposes.
This will give CASA the authority to require the aerodrome certificate holders at certain high-density aerodromes to establish processes that require any vehicle that enters, or moves on, the manoeuvring area of the aerodrome (i) must be fitted with serviceable, operative electronic communication and surveillance equipment; and (ii) must require the vehicle driver to monitor the air traffic control radio frequency while in control of the vehicle at all times that the vehicle is in motion on the manoeuvring area. The procedures established must also prohibit the entry to the aeordrome manoeuvring area of any vehicle not equipped with a serviceable, operative surveillance and communication equipment.
The technical standards for the relevant communication and surveillance equipment will be specified in the MOS Part 139.
