More time to transition to fatigue rules
The impact of COVID-19 has caused disruption to many sectors within the aviation industry. We acknowledge this disruption will also affect industry’s ability to meet the 2020 transition dates for the new fatigue rules in CAO 48.1 Instrument (2019).
In an effort to ease the burden on industry, CASA has made the decision to extend the transition to the new fatigue rules by 12 months. CASA will amend the CAO to reflect the new transition arrangements.
Most operators will need to comply with the new rules from 1 July 2021.
There are three routes for transition to the fatigue rules, with the following updated transition timeframes:
- Prescriptive rules (Appendices 1 to 6) without modification
An operator is required to submit an updated operations manual and Fatigue compliance declaration form (pdf 721.01 KB) by 30 June 2021.
- Prescriptive rules (Appendices 1 to 6) with a minor variation
An operator is required to apply for a minor variation using Fatigue - limited or minor non-compliance (minor variation) application (pdf 1.17 MB) (which includes an operations manual and Fatigue compliance declaration form (pdf 721.01 KB)), and have been granted the minor variation by CASA, by 30 June 2021.
We encourage operators to apply for a minor variation at least three months before the minor variation is required to take effect. For example, if the minor variation is required by 30 June 2021, the completed application should be submitted by 31 March 2021.
- Transition to a trial fatigue risk management system (FRMS)
An operator who is not a high capacity regular public transport operator is required to apply (with all supporting documents) to CASA for approval of an FRMS by 30 June 2021, and will be required to commence the trial (with CASA’s approval) from 1 October 2021.
An operator who is a high capacity regular public transport operator was required to apply for an FRMS by 30 November 2019 and must obtain approval from CASA for their FRMS trial by 30 June 2021.
We will continue to support the industry where we can in these difficult times and are committed to improving the safety regulation of fatigue.
While the transition timeframes have been extended, we encourage a continued focus on fatigue management. You may also choose to opt into the new rules early.
The additional time will also assist those of you working with software vendors to update software to match your new scheduling requirements, particularly those conducting multi-crew operations.
