International AOC holder aircraft overseas maintenance

Effectivity

All aircraft operated on an International AOC.

Purpose

The purpose of this AWB is to confirm the conditions to be met prior to CASA acceptance of a foreign approved maintenance organisation that intends to carry out maintenance on an aircraft of an Australian international Air Operator Certificate.

This AWB is not applicable to countries that have agreements in place with CASA under article 83 of the Chicago Convention, or to National Aviation Authorities (NAA) with whom CASA has a technical agreement. In these cases the recognition of the foreign approved maintenance organisation is achieved through other means.

Background

The Maintenance Standards Branch, of the Aviation Safety Standards Division, is responsible for setting the maintenance standards for all Australian aircraft types. The conditions defined below confirm the conditions required to be met prior to CASA acceptance of overseas maintenance on an aircraft operated on an Australian AOC.

Conditions

The following conditions are required to be met for CASA initial and continuing acceptance of a foreign approved maintenance organisation to carry out maintenance on an aircraft of an Australian international Air Operator Certificate holder:

1. The Organisation

  1. Must be approved-
    1. By CASA under regulation 30, CAR 1988 or in future, Part 145; or
    2. By the appropriate NAA under FAR145, JAR145, TC571 or CAA (NZ) 145; or
    3. By CASA to standards, other than the above; and
  2. Must employ and have available sufficient qualified personnel acceptable to the NAA to carry out and sign the maintenance work; and
  3. Must be in receipt of the necessary Australian Regulations and Orders.

2. The Personnel

  1. For a Contracting State, must meet the requirements of the NAA of that Contracting State for carrying out and certifying maintenance on the specific aircraft type, that should ensure they-
    1. Meet the same standard as prescribed in regulation 31, CAR 1988; and
    2. Hold an ICAO Annex 1 license recognised by CASA, issued by the NAA responsible for the approved maintenance organisation; and
    3. Have their license endorsed for the aircraft type on which maintenance is to be carried out; or
    4. Where company authorisation documents are issued, have the authorisation for the aircraft type on which maintenance is to be carried out; and
  2. To conduct maintenance on the aircraft of an Australian AOC holder the persons may need to hold documentation confirming their successful completion of a differences training course relating to the Australian registered aircraft type conducted under a training program approved by ASSD Maintenance Standards Branch.

3. AOC holders continuing airworthiness procedures

  1. Must fully cover the continuing airworthiness of the aircraft; and
  2. Must include a system of maintenance approved by CASA; and
  3. Must be followed by the foreign NAA approved maintenance organisation.

4. AOC holder audits

  1. Must provide for an initial assessment of the foreign approved maintenance organisation carrying out maintenance; and
  2. For other than one-off arrangements, must provide for the continuing audit by the AOC holder on a regular basis, including two audits of the foreign approved maintenance organisation in the first 12 months of an arrangement; and
  3. The AOC holder's audit plan for foreign approved maintenance organisations must be acceptable to CASA.
