Proposal to Automatically Mandate Compliance with Airworthiness Directives issued by a State of Design - Proposed amendment to Part 39 of the Civil Aviation Safety Regulations 1998 (CASR)

This NPRM introduces, and invites consultation on a proposal to amend the current legislation for Airworthiness Directives (AD).

The proposed changes to Civil Aviation Safety Regulation (CASR) Part 39 address the process to automatically mandate Airworthiness Directives issued by the National Airworthiness Authority (NAA) of the State of Design.

READERS PLEASE NOTE: Currently the Office of Best Practice Regulation (OBPR) is assessing whether CASA needs to submit a Regulatory Impact Statement for the proposed amendment to Part 39, Airworthiness Directives.

Key proposed changes

  • Registered operator must monitor State of Design ADs to ensure compliance.
  • CASA to provide on its website:
    • A list of the States of Design NAA for all type certificated aircraft, aircraft engines and propellers operating on the Australian register.
    • Access links for State of Design ADs.
    • A list of all equipment State of Design NAAs.
    • For a State of Design that does not have an access link, a copy of the State of Design AD.
  • Registered operators can use State of Design AMOC to comply with State of Design ADs.
  • CASA will not list State of Design AMOCs on its website
  • Prior to CASA issuing a CoA, new aircraft models must comply with State of Design ADs.
  • CASA will send only emergency type certificated product ADs (including State of Design ADs) to registered operators.
  • Normal ADs will not be sent to registered operators by CASA.
