CASR Part 99 – Drug and alcohol management plans and testing

Objectives

  • create legislation to enable CASA to require certain aviation industry participants to have in place a drug and alcohol management plan in the interests of the safety of air navigation.
  • proposed regulations will also allow for the random testing of personnel undertaking safety-sensitive aviation activities for alcohol and specified drugs.

Key proposals

  • Introduction by regulation of a Drug and Alcohol Testing Programme for personnel undertaking safety-sensitive aviation activities in the Australian aviation industry, with DAMPS to be managed by industry, and audited by CASA, and an independent random testing regime managed by CASA;
  • The regulations should give effect to the proposal as described in section 2.4 of the NPRM – safety sensitive aviation activities;
  • The regulations should give effect to the proposal as described in section 2.5 of the NPRM – testable drugs.

Consequential amendments to Part 99

As a further consequence of the commencement of the Maintenance suite of regulations, in particular Parts 42, 66 and 145, CASA intends to make minor machinery amendments to CASR Part 99 - Drug and Alcohol Management Plans and Testing.

These amendments involve:

  • adding a reference in regulation 99.015 to issuing a certificate of release to service as a safety sensitive aviation activity (SSAA) to which Part 99 applies; and
  • adding a reference in regulation 99.030 to a Part 145 approved maintenance organisation as an organisation that requires a drug and alcohol management plan (DAMP).

These amendments clarify current requirements in CASR Part 99, in the context of terminology adopted in the Maintenance suite of CASRs.
