Informal Enforcement Action
Informal Enforcement is action taken by CASA that does not involve the exercise of CASA’s specific legislative powers, is generally not reviewable by an external body and is used for less serious breaches. Counselling is the primary form of Informal Enforcement and is generally used where an instance of non-compliance is determined to have been inadvertent, minor, and there is little or no impact on aviation safety.
Counselling may be the most appropriate action in cases of ignorance or misinterpretation of the law. Where non-compliance is the result of a lack of competency a recommendation that remedial training be undertaken may be more appropriate. ( CASA also has the power to require a person to undertake an examination where appropriate.) Informal Enforcement action is generally not an appropriate response to serious contraventions of the legislation. Enforcement Manual, Chapter 4 – Informal Enforcement
