Conditions

Operators will purchase the pre-approved GMEL from CASA. It will also be a condition that the GMEL document itself will at all times remain the property of, and in the custody, control and possession of, CASA. The purchased GMEL will be processed and converted by CASA to an Operator Minimum Equipment List (OMEL). This will then be issued to the operator as an approved OMEL in return for a fee.

The GMEL purchase price will include a yearly assessment and provision of amendments to the GMEL document that result from changes to requirements by the aircraft manufacture or the relevant regulatory body. Amendments will be formally approved in return for a standardised fee. Maintaining a subscription to GMEL is a requirement of the GMEL system.

To protect CASA's intellectual property in the GMEL project, it will be a further condition of the purchase of GMEL that the purchaser surrender to CASA all intellectual property rights (if any) the purchaser has in the OMEL. It is necessary for CASA to protect its intellectual property rights in the GMEL and in specific OMELs because CASA is investing significant financial resources in the GMEL project to ensure a more cost-effective outcome for operators. The GMEL system will not, therefore, be available to non-purchasers, and purchasers are not be permitted to share the OMEL with any other operator.

For operators who do not wish to participate in the GMEL system, the existing procedures for approval of permissible unserviceabilities will remain in place.

Note: Intellectual property rights means all copyright, and neighbouring rights, and all rights in relation to inventions (including patent rights), registered and unregistered trademarks (including service marks), registered designs, confidential information (including trade secrets and know how), databases, and circuit layouts, and all other rights resulting from intellectual activity in the industrial, scientific, literary or artistic fields.

Operator Training Package

Operators who participate in GMEL will be suppled with an Operator Training Package to educate staff in the purpose of an MEL and training in its use. This will be supplied in a DVD format with a workbook, when the OMEL is issued.
