CASR Part 146 – Engineering representatives

CASR Part 146 will prescribe the rules for certification and operation of persons who may have the delegation to perform certain design approval functions under CASR Part 21 on behalf of CASA. These persons can be individuals — Consultant Designated Engineering Representatives (DERs) — or organisations — Organisation Engineering Representatives (OERs).

This is a new Part that will provide a new regime for the certification of persons who approve designs and design changes for aircraft and aeronautical products. It will replace the current system of authorised persons for design approval, in particular CAR (1988) 35 authorised persons. It expanded on the existing CAR (1988) 30 provisions for design organisations to provide for a more systematic and comprehensive system for design approval by organisations.

Who Part 146 affects

  • CAR (1988) 35 authorised persons;
  • CAR (1988) 30 approved design organisations; and
  • Persons and organisations involved in aircraft design, manufacturing and maintenance.

Key proposals

  • Part 146 will cover rules for certification of DER/OERs and their obligations and responsibilities. Part 146 will be supported by a MOS containing detailed mandatory standards, and ACs for guidance material;
  • CASA will delegate certain design approval functions under Part 21 to DER/OERs;
  • The current CAR 35 non specific certification regime is replaced by a detailed certification system that sets out exactly what DER/OERs are certificated to do and the functions they can perform;
  • DER/OERs are required to operate in accordance with their procedure manuals. DER procedure manuals must include an independent checking system. OER procedure manuals must include a quality management system and an internal audit system;
  • The scope of design approvals that CASA will delegate will depend on the DER/OER’s qualifications and experience, and the systems that the DER/OER has in place to carry out the functions; and
  • Coordination of the design approval process to be devolved to OERs (previously, CASA extensively performed the management function). This will allow OERs with sufficient qualified staff to approve major design changes, e.g. to issue limited Supplemental Type Certificates.
