NPRM 0201OS - Air Operator Certification - Air Transport
NPRM 0201OS - Air Operator Certification - Air Transport has been issued for proposed CASR Part 119 which prescribes proposed rules for an applicant wishing to obtain and retain an Air Operators Certificate (AOC) that applies to the operation of air transport operations regardless of size or complexity. Comments close 31 July 2002.

CASR Part 119 – Air operator certification - air transport
Part 119 will prescribe the rules for an applicant wishing to obtain and retain an Air Operator's Certificate (AOC) that applies to Air Transport operations under CASR Parts 121, 133A and 135.
It is proposed that Part 119 will be supported by a Manual of Standards (MOS) that sets out the standards for a Safety Management System (SMS) for an organisation that is the holder of an AOC under Part 119. The manual will also set out the minimum qualification standards for an operator's Head of Aircraft Airworthiness & Maintenance Control, and the minimum standards for an operator's Maintenance Control Manual.
Who Part 119 affects
- Operators of aircraft engaged in Air Transport operations under CASR Parts 121, 133A and 135;
- Aircraft pilots engaged in Air Transport operations;
- Cabin crew;
- Registered Operators of aircraft engaged in Air Transport operations;
- Individuals involved with the airworthiness and maintenance control of aircraft engaged in Air Transport operations; and
- The travelling public (to a lesser extent).
Key proposals
- A single standard for both regular public transport and charter operators;
- Identification of key personnel as defined in the Civil Aviation Act 1988;
- Establishing a new designated person identified as the Safety Manager;
- Making the Chief Executive Officer (CEO) responsible for the safety system and regulatory compliance;
- Requiring operators to develop and maintain a Safety Management System (SMS);
- Requiring operators to provide for crew training and checking, or to arrange for this to be conducted by an organisation approved under CASR Part 142 Training and checking operators;
- Introducing minimum standards for an operator's maintenance control manual;
- Formalising the requirement for the Head of Aircraft Airworthiness & Maintenance Control and the minimum competency standards for that person; and
- Requiring operators to comply with the Maintenance Specific Operations Specification (MSOS) issued by CASA.
Subpart M
A Subpart 119.M will facilitate Air Transport operation of foreign-registered aircraft under a Part 119 AOC. This will provide that foreign-registered aircraft operated by Part 119 AOC holders meet similar airworthiness standards that apply to Australian-registered aircraft in Air Transport operations. Subpart 119.M proposes:
- Introducing a requirement for a specific authorisation for operation of a foreign-registered aircraft;
- Prescribing a time limit for operation of foreign-registered aircraft;
- Setting the standard for acceptance of the type of foreign-registered aircraft an operator may use — similar to Australian-registered aircraft operated by AOC holders;
- Mandating an agreement between the State of registry and CASA for adequate oversight of foreign-registered aircraft; and
- Specifying standards for maintenance of foreign-registered aircraft — in line with ICAO standards and recommended practices.
