CASR Part 115 – Operations using sport aviation aircraft for non-recreational activities

CASR Part 115 has been designed to prescribe and consolidate the requirements and operating rules relating to operation of sport aviation aircraft for hire or reward.

The rules for balloons and gliders will remain essentially the same as the current requirements.

This Part will call up the operating rules of Part 103, and will parallel the operator certification requirements of Part 119 in a similar fashion to the way Part 103 parallels Part 91.

Some of the operations to be dealt with in CASR Part 115 are well established, such as those for the carriage of passengers in charter operations in balloons and sailplanes. Others exist currently by virtue of one-off exemptions to a small number of operators, whilst yet others have been requested by various parties but are beyond the scope of present legislation. Thus some subparts will be relatively easy to draft and readily accepted, whilst others will break new ground and may need to be developed in an extended timeframe.

Who Part 115 affects

Operators of recreational aircraft (including balloons, gliders, gyroplanes, and ultralight aeroplanes) that are engaged in:

  • aerial work; or
  • the carriage of paying passengers.

Key proposals

  • New regulations and standards to be introduced for aerial work, and the possible carriage of passengers for local flights for hire or reward, using gyroplanes and ultralight aeroplanes;
  • Rules to be included for aspects such as flight and duty time limits and cabin attendant requirements for balloon and glider operations as distinct from the provisions set out in Part 119.
  • The Part will incorporate in its maintenance subpart standards for the maintenance of sport aviation aircaft, including reference to maintenance personnel standards, in order to spell out CASA requirements more clearly than at present.
