Parachuting operations from aircraft - Proposed CASR Part 105
The purpose of this NPRM is to initiate formal public consultation on proposed new Part 105 rules for the Civil Aviation Safety Regulations (CASRs).
CASR Part 105 has been designed to provide a simplified set of rules that are appropriate to the parachuting industry and which are currently subject to various specifications under the Civil Aviation Regulations 1988 (CARs). The standards that have been embodied in Part 105 are consistent with what is accepted as best practice amongst the international sport parachuting community, through organisations such as the International Parachuting Commission of the FAI (the Federation Aeronautique Internationale, the international body that administers airsports) and the Parachute Industry Association.
Part 105 consolidates, in one set of regulations, the rules applying to people who carry out sport and recreational parachuting from aircraft. This includes not only the training of people who seek to carry out these activities, but also the tandem carriage of persons who seek to experience sport and recreational parachuting under the supervision and administration of peer-group organisations established and authorised for the purpose, as well as parachute maintenance organisations.
The activities that may be conducted under the Part 105 rules include:
- personal parachuting activities;
- parachute training in all forms including tandem, static line and accelerated free fall; and
- sporting and recreational parachuting including competition, maintenance of parachuting equipment, and any additional activities for which an administering organisation has prepared rules acceptable to CASA.
Part 105 will also establish a 'parallel pathway' for CASA to administer this activity when individual participants, for whatever reason, choose not to participate as members of an administering organisation.
Because people who engage in parachuting from aircraft are voluntary participants in this activity, whereby they have indicated an understanding and acceptance of the risks of participation, sport and recreational parachuting would attract a lower regulatory priority and intervention by CASA beyond the need to protect the public on the ground and other airspace users from the effects of that activity.
The proposed rules minimise the risks to which the public and other airspace users are exposed, and provide for their administration, to the greatest extent possible, by industry organisations to be authorised under another proposed ruleset: CASR Part 149 Recreational aviation administration organisations. Formal consultation on Part 149 will occur in the 2nd quarter of 2007.
