Amendments to CAO Part 82 – Safety Management Systems, Crew Resource Management, true copy of AOC on international flights

Purpose/Objectives

Amend the following CAOs in a staged approach, and in the order listed, to require the respective Operators to implement a management system specifically designed to ensure safety outcomes (SMS) and to implement training programs to develop their pilots' skills in the non-technical safety related matters such as Human Factors/Performance and CRM.

  • CAO 82.5 for Regular Public Transport in high capacity aircraft.
  • CAO 82.3 for Regular Public Transport in low capacity aircraft.
  • CAO 82.1 For Charter and Aerial Work operations. The amendment will only affect Passenger Charter Operations because CASA policy and future legislation will have all passenger carrying operations categorised as an Air Transport activity.

On an opportunity basis, include the requirements to carry a true copy of the AOC for international operations.

Background

Development of Part 119, and other operational Parts, began in June 1996. However, the requirement to have a Safety Management System (SMS) was introduced later and included in Part 119 NPRM 02010S-April 2002. The preceding Discussion Paper, DP 0030S-May 2000, introduced Quality Assurance and the Systems Approach to safety management, which was subsequently embodied into the SMS proposal outlined in the NPRM.

Since CASA's development work above, there have been International developments to introduce SMS. ICAO in 2003 recommended SMS requirements for International Aerodrome Operations and Air Traffic Service Providers. This was then mandated by ICAO on 24 November 2006.

Also from 24 November 2006, ICAO recommended SMS requirements for Air Transport Operators and other Aviation Organisations directly supporting Air Transport Operations. This requirement will be made mandatory by ICAO from 24 November 2009.

Since around 1998, CASA has been encouraging AOC holders to implement SMS and considerable education work, to that end, has been done. In the past three or four years CASA auditing of Air Transport Operators has included assessment of their respective safety management processes/systems, and satisfactory management of safety in operations has been largely regarded under the general governance requirements of Section 28BE of the Civil Aviation Act.

Since around 2002/2003 both CASA and Air Transport Operators have been working in anticipation of Part 119 being enacted into legislation and SMS requirements being specifically defined in that legislation. A similar scenario can be described in regard to requirements for pilot non-technical safety related skills, such as Human Factors/CRM.

However, there have been significant and some unexpected delays with the development of Part 119, and to ensure the safety benefits of the above systems are realised as soon as possible, CASA will be fast-tracking SMS and non-technical safety skills through progressive amendments to CAO 82 series relating to passenger carrying operations. The CAO amendments will be consistent with planned requirements being developed for the future Part 119.

In relation to carrying a true copy of AOC on international flights, this is an ICAO requirement and the opportunity can be taken to include this with the above proposed CAO amendments.
